By accessing or using the services ("Services") provided by My Listening Line Inc. ("we," "us," or "our"), you ("Caller" or "you") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our Services
Description of Services
My Listening Line Inc. provides two distinct services:

Empathetic Listening: A non-clinical service where trained Listeners provide emotional support and active listening. This service does not constitute medical or mental health treatment, diagnosis, or advice.

Professional Therapy: A clinical service provided by licensed, certified Therapist Listeners, which includes diagnosis, treatment, and professional mental healthcare. You must book this service specifically to receive clinical care
User Account and Eligibility
To use our Services, you must be at least 18 years of age. If you are between the ages of 13 and 17, you may only use our Services with the verifiable consent of a parent or guardian. By creating an account, you agree to provide accurate and complete information
Fees, Payment, and Cancellation

Fees: You agree to pay all fees as displayed at the time of booking.

Cancellation: You may cancel or reschedule a session without charge with more than 24 hours' notice. Cancellations with less than 24 hours' notice will be charged the full session fee.

Refunds: Refunds are only provided in cases of technical failure on our end or Listener no show. No refunds are given for completed sessions or based on dissatisfaction with the content of a conversation.
Recording and Podcast Consent
All Sessions Are Recorded: For quality assurance, training, and content purposes, all sessions are recorded.

Explicit Consent Required: Before your session begins, you must provide explicit verbal consent for the recording and its potential uses.

Podcast Use: With your consent, anonymized excerpts from recordings may be used on the "My Listening Line" public podcast. We will remove all personally identifiable information and may alter voices to protect your anonymity.

Withdrawal of Consent: You may withdraw your consent for your recording to be used on the podcast within 5 days of your session by contacting us at info@mylisteningline.com with WITHDRAWAL OF CONSENT in the subject line.

Intellectual Property
All session recordings, website content, and materials are the intellectual property of My Listening Line Inc.. You grant us a perpetual, royalty-free license to use the anonymized recording for the purposes described in Section 5.
Limitation of Liability
To the fullest extent permitted by law, My Listening Line, its directors, employees, and Listeners shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services or the actions of a Listener
Governing Law
These Terms are governed by the laws of Alberta, Canada.

Agreement to Terms
This Independent Contractor Agreement ("Agreement") is entered into between My Listening Line Inc. ("Company") and you, the Listener ("Contractor"). Contractor is an independent contractor, not an employee, agent, or partner of the Company. Contractor is solely responsible for their own taxes, insurance, and benefits
Services and Scope of Work
Contractor agrees to provide listening services ("Services") to users of the Company's platform.
Contractor must:

Complete all required training and pass a background check.

Adhere to all scripts, guidelines, and ethical codes provided by the Company.

For Empathetic Listeners: Provide non-clinical support only. Strictly prohibited from giving medical or mental health advice.

For Certified Therapist Listeners: Provide clinical therapy within their licensed scope of practice. Must maintain active, unrestricted licensure and own professional liability insurance.
Compensation
Contractor will be paid per completed session, as detailed in the Company's Compensation Plan.

Any commissions or bonuses are paid quarterly via direct deposit.

No compensation is provided for no-show calls, cancelled calls, or time spent in training.
Confidentiality
Contractor agrees to hold all information related to Callers in strictest confidence. Contractor shall not disclose, reproduce, or use any Caller information for any purpose other than providing Services on the platform
Restrictive Covenant (Non-Solicitation)
During the term of this Agreement and for a period of two (5) years after its termination, Contractor shall not, directly or indirectly, solicit, contact, or do business with any user of the Company's platform for whom Contractor provided Services
Recording and Intellectual Property
Contractor consents to all sessions being recorded.

All recordings, training materials, and scripts are the sole intellectual property of the Company.

Contractor grants the Company full rights to use the recordings for training, quality assurance, and podcast content.
Term and Termination
This Agreement may be terminated by either party with written notice. The Company may terminate immediately for breach of confidentiality, ethical violations, or solicitation of clients
Limitation of Liability
The Company is not liable for any claims, damages, or losses arising from the Contractor's provision of Services. Certified Therapist Listeners are solely liable for the clinical care they provide
Governing Law
These Terms are governed by the laws of Alberta, Canada.
